GENERAL TERMS AND CONDITIONS OF USE (T&Cs) FOR THE TRAVELQUEEN APPLICATION

These General Terms and Conditions of Use (hereinafter the “T&Cs”) govern the access and use of the TravelQueen mobile and web Application (hereinafter the “Application”) published by the simplified joint-stock company (SAS) SIMPLY STUPID SOFTWARE (hereinafter “SIMPLY STUPID SOFTWARE” or “We”).

These T&Cs, together with our Legal Notice, our Privacy Policy, as well as any other specific terms or conditions that may be published on the Application, form the entire contractual agreement (the “Agreement”) between the User and SIMPLY STUPID SOFTWARE governing the access and use of the Application. This Agreement cancels and replaces all prior or contemporaneous agreements, negotiations, and communications between the parties, whether oral or written, concerning the same subject matter.

Prior to any use of the Application, the User is invited to carefully read these T&Cs.

The use of the Application and access to its features, including the creation of a User account or the generation of a Suggested Itinerary, are strictly conditional upon the prior, explicit, full, and entire acceptance of these T&Cs by the User.

This acceptance is materialized by the User actively ticking the box indicating “I have read and accept the General Terms and Conditions of Use” presented during the account creation process and before the generation of a Suggested Itinerary.

By ticking this box, the User acknowledges having had the opportunity to read, understand, and unreservedly accept all the provisions of these T&Cs, which form a contract between the User and SIMPLY STUPID SOFTWARE.

If you do not accept these T&Cs, you must not tick the acceptance box and you must not use the Application.

1. DEFINITIONS

For the purposes of these T&Cs, the following terms shall have the meaning assigned to them below:

  • Application: refers to the TravelQueen mobile and web application published by the company SIMPLY STUPID SOFTWARE.
  • User: refers to any natural or legal person accessing and/or using the Application.
  • User-Provided Content: refers to all data, information, or textual content (such as chosen destinations, travel dates, expressed preferences, comments, or text entered in free-text fields) that the User enters, submits, or actively provides when using the Application.
  • Suggested Itinerary: refers to the detailed travel plan, including suggestions for activities, accommodation, transport, as well as potentially descriptive texts and images generated by AI, which is produced and displayed by the Application in response to the information provided by the User.
  • Partners: refers to third parties offering activities, accommodation, transport, dining, or products and services, accessible via the Application.
  • Geny: refers to the artificial intelligence (AI), personified by a personal travel assistant named Geny.

2. DESCRIPTION OF THE APPLICATION

TravelQueen is not a travel agency, nor a travel organizer or retailer within the meaning of Articles L211-1 et seq. of the French Tourism Code. The Application provides suggestions for itineraries and activities for purely informational purposes and provides affiliate links to Partner sites. SIMPLY STUPID SOFTWARE does not sell any travel services, does not enter into any travel contracts with the User, and does not receive any payment from the User for the suggested services. Bookings and payments are made exclusively on the Partners’ sites, according to their own general terms and conditions.

The Application suggests a program of activities (paid or free), the best transport and accommodation offers.

TravelQueen displays offers for activities, accommodation, restaurants, and transport (flights, trains, car rental, etc.) available at the time of the User’s request.

By clicking on these offers, the User is redirected to the websites of commercial Partners or to Google to obtain more information or make a booking.

The User has the option to perform independent searches via integrated widgets within the Application, allowing, for example, to find accommodation and transport offers.

The Application may also provide information related to the destinations included in the Suggested Itinerary, such as weather, practical information (e.g., local practices, customs, etc.).

A currency conversion tool may be offered if the currency used at the destination differs from that of the User.

TravelQueen integrates external artificial intelligence, personified by a personal travel assistant named Geny, to assist in generating itineraries.

SIMPLY STUPID SOFTWARE does not guarantee any results regarding the suggestions and images provided by Geny.

The Application is available on mobile platforms (iOS and Android) and via a web browser.

It is available with freemium access for Users. A premium version is currently under development.

3. ACCESS AND USE OF THE APPLICATION

Access to the Application is free and can be done without creating an account.

However, certain features may require the creation of a User account.

3.1 User Account Creation and Management

Users can create an account free of charge by providing an email address, a first name, and a password.

Account creation via email address is subject to validation of the provided address.

Users also have the option to log in via their Google or Apple accounts.

In this case, no email validation is required.

The account identifier is the email address provided by the User.

Passwords must be strong, chosen by the User under their own responsibility.

To enhance account security, Users are recommended to choose a complex password and change it regularly.

The User is responsible for the confidentiality of their password and agrees to inform SIMPLY STUPID SOFTWARE without delay of any unauthorized use of their account.

SIMPLY STUPID SOFTWARE cannot be held liable for any loss or damage resulting from failure to comply with this obligation.

The User may delete their account at any time in accordance with Article 10 “Account Deletion”.

It is reminded that account deletion will result in the loss of access to the history of generated trips, as specified in Article 10.

SIMPLY STUPID SOFTWARE reserves the right to suspend or terminate a User’s access to their account, under the conditions provided for in Article 10.

3.2 Use of the Application

The User agrees to use the Application in accordance with these T&Cs and applicable laws and regulations.

The User is responsible for the quality of the content they may add in the free text fields.

The User has the possibility to modify their language, country, and currency preferences in the Application settings.

These preferences are initially deduced from the language of the browser used by the User.

4. FINANCIAL CONDITIONS

The TravelQueen Application is free for Users.

TravelQueen’s business model is based on affiliation with commercial Partners offering activities, accommodation, dining, transport, and travel-related products and services.

When the User clicks on offers and is redirected to the websites of these Partners (including GetYourGuide, Viator, Amazon, and other platforms), SIMPLY STUPID SOFTWARE may receive remuneration from them if the User makes a purchase.

This remuneration is paid by the commercial Partner and entails no additional cost for the User.

In accordance with current legislation, links leading to Partner offers that may generate remuneration for SIMPLY STUPID SOFTWARE (affiliate links) are identified within the Application by a mention or a distinctive sign specifying their commercial nature.

Recommendations for activities, accommodation, transport, dining, and other travel services are provided in good faith based on the information available at the time of the User’s request.

However, the User is informed that TravelQueen’s business model relies partly on affiliation with commercial Partners, which may influence the nature of the offers proposed. SIMPLY STUPID SOFTWARE nevertheless strives to offer relevant suggestions for the User.

SIMPLY STUPID SOFTWARE does not add any additional fees to the prices displayed by Partners at the time of the User’s request.

Advertisements may be displayed on the Application (for example, during loading times) as another source of revenue for TravelQueen.

5. CONTENT AND INTELLECTUAL PROPERTY

5.1 Intellectual Property of SIMPLY STUPID SOFTWARE

The “TravelQueen” trademark has been registered with the European Union.

The “TravelQueen” logo and name have been registered with the INPI in France (French National Institute of Industrial Property).

The company SIMPLY STUPID SOFTWARE holds all intellectual and industrial property rights relating to the brand, logo, name, Application, its content (with the exception of User-Provided Content as defined below), its design, as well as the software, databases, and processes used for its operation.

Any reproduction, representation, modification, adaptation, distribution, and/or exploitation of all or part of these elements, by any means and on any medium whatsoever, without the prior written authorization of SIMPLY STUPID SOFTWARE, is strictly prohibited and may constitute infringement.

5.2 Intellectual Property of the Suggested Itinerary and Licenses for Use

The User acknowledges and agrees that the Suggested Itinerary generated using the Application (including texts and images potentially generated by AI) constitutes a protected work and is the intellectual property of the company SIMPLY STUPID SOFTWARE.

SIMPLY STUPID SOFTWARE grants the User a personal, non-exclusive, non-transferable, and revocable right to use this Suggested Itinerary, solely for their personal travel planning and inspiration needs.

This right includes the possibility to:

  • Consult the Suggested Itinerary within the Application.
  • Share it with relatives in a strictly private context.
  • Print it for personal use during the trip.
  • Keep it for archiving or personal inspiration for future trips.
  • Use non-substantial excerpts in a private context.

This license to use the Suggested Itinerary is expressly granted on the condition that the User fully acknowledges the purely informational, indicative, and non-guaranteed nature of the Suggested Itinerary (as detailed notably in Articles 5.4 and 8) and assumes full responsibility for verifying all information and suggestions it contains (including, but not limited to, safety, accuracy, feasibility, schedules, access conditions, prices, formalities) before making any decision, incurring expenses, or undertaking their trip.

Any other use of the Suggested Itinerary, and in particular any commercial exploitation, reproduction, or total or partial public dissemination, outside the Application, is strictly prohibited without the prior express written consent of SIMPLY STUPID SOFTWARE.

Furthermore, subject to full compliance with these T&Cs, SIMPLY STUPID SOFTWARE grants the User a limited, non-exclusive, non-transferable, and revocable license to access and use the Application itself on their personal device, in accordance with its features.

The licenses granted in this article do not confer upon the User any intellectual property rights over the Application, the Suggested Itinerary (other than the limited right of use defined above), the underlying technology (including the AI Geny), algorithms, source codes, databases, trademarks, logos, or any other element belonging to SIMPLY STUPID SOFTWARE or its licensors.

5.3 User Responsibility regarding User-Provided Content

The User is solely responsible for the accuracy and completeness of the information they provide when generating a trip, including in the free text fields.

The User agrees not to enter any unlawful, defamatory, sexual, dangerous, or inappropriate content.

The User grants SIMPLY STUPID SOFTWARE a non-exclusive, royalty-free license, for the duration of use of the Application, authorizing SIMPLY STUPID SOFTWARE to use, host, store, reproduce, modify, communicate, publish, translate, and distribute the User-Provided Content within the scope of the operation of the Application and the provision of services.

5.4 Role, Limits, and Use of Artificial Intelligence (Geny)

The artificial intelligence “Geny,” integrated into the Application, is a tool to assist in generating travel itineraries. The suggestions, information, and images it provides are generated automatically and are offered for purely indicative purposes. The User acknowledges and accepts that this information may contain errors, inaccuracies, or be outdated, and that it in no way replaces human judgment or the need to consult reliable and official sources of information.

SIMPLY STUPID SOFTWARE makes reasonable efforts to ensure the general relevance of Geny’s suggestions. However, SIMPLY STUPID SOFTWARE guarantees neither the absolute accuracy, nor the completeness, nor the safety, nor the suitability of the generated information to the specific needs, personal situation, or expectations of the User.

It is imperative for the User, and falls under their sole and entire responsibility, to systematically verify, through independent means, the accuracy, relevance, feasibility, safety, and up-to-dateness of all information and suggestions provided by Geny before making a decision, incurring an expense, booking a service, or undertaking their trip. This verification must notably cover schedules, prices, access conditions, location, safety of places and activities, administrative and health formalities, etc.

Consequently, SIMPLY STUPID SOFTWARE cannot be held liable for direct or indirect damages (such as financial losses, delays, cancellations, safety issues, disappointments) that may result from the User’s reliance on the information provided by Geny without having carried out the necessary checks stipulated in the paragraph above. This limitation of liability does not apply in the event of proven fault by SIMPLY STUPID SOFTWARE in the provision of the service that directly caused the damage.

6. USER CONDUCT

The User agrees to use the Application responsibly and respectfully.

It is notably forbidden to:

  • Use the Application for illegal purposes or contrary to public order and good morals.
  • Upload, post, email, or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, racist, or otherwise objectionable.
  • Impersonate any other person or entity.
  • Disrupt or attempt to disrupt the operation of the Application, notably by introducing viruses, malware, or any other element likely to cause damage.
  • Use the Application in an abusive or disproportionate manner.

In the event of a breach of these obligations, SIMPLY STUPID SOFTWARE reserves the right to suspend or delete the User’s account, where applicable, and to take any action it deems appropriate.

7. NOTIFICATIONS

Users can choose to enable or disable the receipt of notifications (by email or push notifications) in the Application settings.

These notifications may concern new features, travel suggestions, reminders about upcoming trips, or other relevant information.

SIMPLY STUPID SOFTWARE does not commit to any particular frequency for sending these notifications.

The User is informed and accepts that receiving notifications may incur data charges billed by their mobile operator, for which SIMPLY STUPID SOFTWARE cannot be held responsible.

SIMPLY STUPID SOFTWARE will inform Users of significant changes to the T&Cs through appropriate channels (including via a notification in the Application or by email).

In this case, the User will be asked to explicitly validate the new T&Cs to continue using the Application.

8. DISCLAIMER OF WARRANTIES

The Application and its content are provided “as is” and “as available”.

SIMPLY STUPID SOFTWARE does not guarantee the accuracy, completeness, reliability, or relevance of the information provided, particularly concerning Partner offers, weather information, currency conversion simulations, or suggestions from the artificial intelligence Geny.

The User acknowledges using the Application and the information it contains under their sole responsibility and that it is their responsibility to carry out all necessary checks before undertaking a trip or booking services with Partners.

The User acknowledges and accepts that information relating to offers for activities, accommodation, transport, dining, travel-related products, and services is provided by our commercial Partners.

SIMPLY STUPID SOFTWARE strives to present up-to-date information but does not guarantee in any way the accuracy, completeness, availability, or quality of these offers.

In case of problems or complaints regarding these offers, the User is invited to contact the relevant commercial Partner directly, as SIMPLY STUPID SOFTWARE is not responsible for the quality of services or products offered by its Partners.

The currency conversion feature is provided for indicative purposes only, and rates are updated once a day via an external API.

SIMPLY STUPID SOFTWARE does not guarantee the accuracy of the exchange rates in any way, including immediately after this daily update.

Similarly, weather information is provided by an external API and is updated each time the User opens the trip.

Although SIMPLY STUPID SOFTWARE strives to provide up-to-date information, it does not guarantee its accuracy or reliability in any way.

SIMPLY STUPID SOFTWARE does not guarantee that the Application will be free from errors, bugs, or interruptions, nor that it will be compatible with all types of devices.

SIMPLY STUPID SOFTWARE cannot be held liable for any service interruption, malfunction, or unavailability of the Application due to a force majeure event or any other event beyond its reasonable control.

SIMPLY STUPID SOFTWARE offers no guarantee as to the suitability of the Application for the User’s specific needs.

9. LIMITATION OF LIABILITY

9.1. Role of SIMPLY STUPID SOFTWARE

It is recalled that SIMPLY STUPID SOFTWARE acts as the publisher of the Application providing itinerary suggestions generated by Artificial Intelligence for informational purposes, and as a technical intermediary offering affiliate links to Partner sites. SIMPLY STUPID SOFTWARE is not a travel agent, does not organize or sell any travel services, and is not a party to contracts concluded between the User and the Partners. Its role is limited to providing the Application tool and the information it contains, under the terms of these T&Cs.

9.2. Disclaimer of Liability regarding Partners

As a consequence of its role as an intermediary and non-party to the contracts binding the User to the Partners, SIMPLY STUPID SOFTWARE cannot be held liable for the availability or content of Partner sites, the offers proposed by them, nor for the proper or improper execution of services (activities, accommodation, transport, etc.) potentially booked by the User with Partners via affiliate links. Any request, claim, or dispute concerning a Partner’s services must be addressed directly to the latter, who solely assumes contractual and legal responsibility towards the User.

9.3. Liability of SIMPLY STUPID SOFTWARE for the Application

In the context of providing the Application, SIMPLY STUPID SOFTWARE is bound by an obligation of means (obligation de moyens). It undertakes to make reasonable efforts to ensure the proper technical functioning of the Application and the general relevance of the information and suggestions provided, notably by the AI Geny, in accordance with the limits and warnings described in these T&Cs (in particular in Articles 5.4 and 8).

The liability of SIMPLY STUPID SOFTWARE for the use of the Application by the User can only be sought in the following cumulative cases:

  • A proven fault directly and exclusively attributable to it in the execution of its obligations
  • Direct, certain, and personal damage suffered by the User
  • A direct and established causal link between the proven fault of SIMPLY STUPID SOFTWARE and the damage suffered by the User.

The essential duty of verification incumbent upon the User (as detailed in Article 5.4) is expressly recalled, compliance with which is a condition for using the Application and will be taken into account in assessing any potential liability.

9.4. Limitation of Remedy (Indirect Damages)

In the event that SIMPLY STUPID SOFTWARE’s liability is validly engaged in accordance with Article 9.3, the compensation due to the User will be strictly limited to the direct and certain damages suffered by the latter, as demonstrated.

Subject expressly to mandatory legal provisions and public policy (particularly regarding bodily harm or willful misconduct or gross negligence by SIMPLY STUPID SOFTWARE), SIMPLY STUPID SOFTWARE can under no circumstances be held liable for indirect damages, whatsoever, foreseeable or unforeseeable, suffered by the User or third parties.

Are notably considered indirect damages, without this list being exhaustive: any loss of profits, loss of revenue, loss of opportunity, loss of expected savings, loss of data, commercial prejudice, increase in costs, moral damage, unnecessarily incurred costs or expenses (transport, non-refundable accommodation, etc.), or any consequence related to a disorganization of the User’s trip.

9.5. Force Majeure

The liability of SIMPLY STUPID SOFTWARE cannot be engaged if the non-performance or delay in the performance of one of its obligations described in these T&Cs results from a case of force majeure. Force majeure means any external, unforeseeable, and irresistible event within the meaning of Article 1218 of the French Civil Code and French case law.

10. ACCOUNT DELETION

The User can delete their account at any time via the Application settings.

Account deletion will result in the deletion of their personal information, as well as the history of generated trips, subject to legal retention obligations.

SIMPLY STUPID SOFTWARE reserves the right to suspend or delete a User’s access to the Application, as well as their account, without notice or compensation, particularly in the event of provision of unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene content, invasion of privacy, hateful, racist, or otherwise objectionable content, in case of abusive use of the Application, prolonged account inactivity, or for any other legitimate reason, including in case of breach of any provision of these T&Cs.

11. INTELLECTUAL PROPERTY

It is recalled that the “TravelQueen” trademark, its logo, and its name are the exclusive property of the company SIMPLY STUPID SOFTWARE.

Similarly, the Suggested Travel Itineraries generated by the Application are the exclusive property of SIMPLY STUPID SOFTWARE, with the User having a limited right of use as defined in Article 5.2.

12. PERSONAL DATA

The management of Users’ personal data is governed by our Privacy Policy, which is an integral part of these T&Cs and accessible via this link.

TravelQueen uses analytics tools, including Application Insights, to understand the use of the Application, optimize our services, and adapt features to User needs.

These tools may collect information such as browsing habits and general demographic data.

13. FEEDBACK AND SUGGESTIONS

TravelQueen appreciates feedback and suggestions from Users regarding the Application.

The User expressly acknowledges and agrees that SIMPLY STUPID SOFTWARE, at its sole discretion, shall have the right to use, copy, modify, publish, display, distribute, and incorporate such feedback and suggestions into the Application or its services, without any obligation of compensation or acknowledgment towards the User.

For any questions, complaints, or requests for assistance regarding the Application or these T&Cs, the User may contact SIMPLY STUPID SOFTWARE:

  • Via the contact form available on the TravelQueen website (a redirect link is also available on the mobile Application to the website’s contact page).

SIMPLY STUPID SOFTWARE will endeavor to respond to requests within a reasonable timeframe. However, depending on the complexity of the request, a longer processing time may be necessary. In all cases, SIMPLY STUPID SOFTWARE will acknowledge receipt of the User’s request within 7 working days and will keep the User informed of the progress of its processing.

15. ACCESSIBILITY

SIMPLY STUPID SOFTWARE strives to make TravelQueen accessible to the greatest number of users. However, the User acknowledges and accepts that the Application may have accessibility limitations for certain categories of people with disabilities.

The User accepts that the use of the Application is “as is” and acknowledges that SIMPLY STUPID SOFTWARE cannot be held responsible for a lack of accessibility for certain users.

SIMPLY STUPID SOFTWARE invites Users encountering access difficulties to contact it via the contact methods indicated in Article 14 to provide their feedback. SIMPLY STUPID SOFTWARE will take this feedback into account for potential future improvements to the Application.

16. APPLICABLE LAW AND COMPETENT JURISDICTION

These T&Cs are governed by French law.

In the event of a dispute, and after attempting to find an amicable solution, the French courts shall have jurisdiction.

In accordance with Article R. 631-3 of the French Consumer Code, the consumer User may bring the matter either before one of the courts having territorial jurisdiction under the Code of Civil Procedure, or before the court of the place where they resided at the time the contract was concluded or when the harmful event occurred.

If any provision of these T&Cs is deemed invalid or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.

The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely matches the original intent of the parties.

17. ASSIGNMENT

SIMPLY STUPID SOFTWARE reserves the right to assign or transfer its rights and obligations under these T&Cs to any affiliated company or any successor in the event of a merger, acquisition, or sale of all or part of its assets.

The User may not assign or transfer their rights and obligations under these T&Cs without the prior written consent of SIMPLY STUPID SOFTWARE.
